General Terms and Conditions of the Matterhorn Valley Hotels

The regulation creates order

1. conclusion of the contract

By registering, the guest makes a binding offer to the hotel to conclude an accommodation contract. The registration can be made in writing, verbally or by telephone. It is also made by the registrant for all participants listed in the registration, for whose contractual obligation the registrant is responsible as for his own obligations. The contract is concluded upon acceptance by the hotel.

The acceptance does not require a specific form.

If the content of the confirmation differs from the content of the registration, a new offer by the hotel is available to which it is bound for a period of 2 days. The contract is concluded on the basis of this new offer if the guest declares acceptance to the hotel within the binding period.

If a written contractual offer is sent to the applicant/orderer, the hotel shall be bound by this offer until the date agreed in writing. If the hotel has not received the contract signed by the customer by this date, the offer shall become ineffective and can no longer be accepted by the customer.


2. Prices

Prices are to be understood as final prices including the legal VAT and excluding the tourist tax. In the event of an increase in VAT after conclusion of the contract, the hotel reserves the right to adjust prices accordingly.
Any kind of vouchers, promotions, discounts as well as the redemption of collected Club Card points is only possible if this has been registered and confirmed in advance.


3rd cancellation / reduction

The hotel and the customer are entitled to withdraw from the reserved rooms/premises.
Cancellation of the contract / change of contract regarding the number of participants / overnight stays must be communicated in writing.

3.1. complete cancellation of the reservation free of charge (also overnight stay portion of half board)

The complete contractually agreed room reservation can be returned free of charge according to the following criteria:

Winter season:

28 - 21 days before arrival = free of charge

21 - 14 days before arrival = 50% of the reservation

14 - 00 days before arrival = 80% of the reservation

Summer season:

14 - 07 days before arrival = 25% of the reservation

07 - 03 days before arrival = 50% of the reservation

03 - 00 days before arrival = 80% of the reservation

The number of overnight stays is the number of reserved rooms x number of nights.

3.3 Cancellation costs for reservations (also overnight stay share of half board)

Reservation fees are only due if the hotel is no longer able to rent the rooms to another party. Price differences can be claimed by the hotel.


4. payment

For reservations with a total turnover of CHF 1000.00 or more, an advance payment of 30% is due four weeks before arrival. If this advance payment is not made, the hotel is entitled to withdraw from the contract. In this case, the guest is obliged to pay a contractual penalty of 20% of the total turnover. After the period of use of the hotel service, the invoice amount is to be paid before departure.


5. force majeure and threat to the smooth running of business, safety or reputation of the hotel

The hotel reserves the right to terminate the contract in the event of events beyond the hotel's control, such as fire, natural disasters, strikes, lockouts, delivery bottlenecks. The hotel also has the right to cancel the contract if a reservation threatens to jeopardize the smooth business operations, safety or reputation of the Matterhorn Valley Hotels. The assertion of any claims for damages against the hotel is excluded in this case.


6. adhesion

The Hotel assumes no liability for objects and valuables brought in by the Guest, unless the Hotel can be proven to have acted with intent or gross negligence. The Guest shall only be entitled to offset and withhold payment against undisputed or legally binding counterclaims. The Guest is obligated to the Hotel to assert the loss of items brought in immediately, but no later than upon departure. The Guest is liable for all damage caused by him/her in his/her room or public areas of the Hotel during the agreed period of use.


7. amendments to the agreements

Any change to a written agreement made must be made in writing.


8. final provision

Should individual provisions of these terms and conditions be invalid, this shall not affect the validity of the remaining provisions. In place of the ineffective provision, a new provision shall apply.
